Pravna urejenost je pri nepremičninah eden ključnih elementov, ki lahko pomembno vplivajo na doseženo ceno in prodajne pogoje. Zato pred začetkom prodajnega procesa ni dovolj le kvalitetna priprava nepremičnine v naravi (ureditev nepremičnine, priprava kvalitetnih fotografij, opisa, oglasa, idr.), temveč je potrebno predvsem tudi opraviti pravni pregled nepremičnine ter morebitna odprta pravna vprašanja po možnosti že vnaprej pravno urediti oziroma ustrezno nasloviti. - Poleg stavbe se prodaja še zemljišče, ki je v prostorskih aktih opredeljeno deloma kot kmetijsko in/ali gozdno: potrebno je razmisliti, kako pristopiti k postopku prodaje »preko oglasne deske«, ki ga zakon predpisuje pri prodaji gozdnih in kmetijskih zemljišč.
- Stanovanje, ki je predmet prodaje, ni etažirano: neurejena etažna lastnina pomeni, da imajo sosedje predkupno pravico; tudi sicer pa je takšna nepremičnina tržno manj privlačna.
- Objekt nima pravno-formalno urejene dostopne poti do javne ceste: čeprav v naravi »že 100 let« ni nobene težave je ne-ureditev ustrezne služnosti lahko ovira pri dodelitvi kredita kupcu za nakup takšne nepremičnine.
- Hiša oz. objekt je bil tekom let nekoliko predrugačen brez ustreznih dovoljenj: takšna situacija lahko pomeni le manjše, dopustno odstopanje – lahko pa gre za bistveno napako, kar je potrebno preveriti od primera do primera.
- Na nepremičnini so vpisane hipoteke: v procesu prodaje je potrebno pripraviti strategijo, ki bo omogočila, da bo lahko kupec kupil bremen prosto nepremičnino.

Legal preparation of Real Estate before sale
Legal point of view can have a significant impact on the achieved final price and sales conditions when selling real estate; therefore, it is one of the key aspects that has to be taken into consideration in real estate sales. As a consequence, before the start of every sales process, it is not enough to only physically prepare the real estate (cleaning, preparation of quality photos, advertisement, etc.), but above all it is also necessary to carry out a thorough legal review of the real estate in order to address any open legal questions already in advance. Some typical cases that need active legal preparation are, for example:
- Cases, where in addition to the building, agricultural land / forest land is also being sold: it is necessary to define how to approach to the sales process “through the notice board”, which is a mandatory administrative procedure prescribed by law in Slovenia for the sale of forest and agricultural land.
- Cases of buildings, where the commonhold has not (yet) been organized: according to Slovene law, in such cases, neighbors have pre-emptive rights which has to be taken in consideration in the process.
- Cases where buildings (houses) do not have formally arranged access road to the public road: although there is no problem in nature “since over 100 years”, failure to register the appropriate right in the land registry can hinder granting of credit by banks to potential buyers of the property.
- Cases in which the house/apartment in question has been »slightly modified« over the years without appropriate permits: such a situation can either mean a minor, permissible deviation – or it can represent a significant error, which needs to be addressed on a case-by-case basis.
- Cases, where there are mortgages registered on the property: in the sales process, it is necessary to prepare a strategy that will enable the buyer to purchase a »clean« property.
