Je pri Vaši nepremičnini vpisana hipoteka starejšega datuma? V določenih primerih je takšna hipoteka lahko že zastarana. V tej zvezi je potrebno najprej preveriti časovne okvire nastanka takšne hipoteke:
- Hipoteke, nastale pred 1. 9. 1980, tj. v času uporabe Občega državljanskega zakonika (ODZ). ODZ je predvideval možnost zastaranja hipotek s pretekom roka tridesetih let.
- Hipoteke, nastale med 1. 9. 1980 in do 31. 12. 2002, tj. v času veljavnosti Zakona o temeljnih lastninskih razmerjih (ZTRL). Skladno s prakso Vrhovnega sodišča (gl. sodbo opr. št. II Ips 844/2007 z dne 20. 5. 2010) za hipoteke, nastale v tem časovnem intervalu, velja, da niso zastarljive. Tj. da poplačilna pravica hipotekarnih upnikov iz teh hipotek ne zastara.
- Hipoteke, nastale po 1. 1. 2003, tj. v času veljavnosti Stvarnopravnega zakonika (SPZ). Aktualni SPZ pa v določbah tretjega odstavka 154. člena sedaj določa, da hipoteka ugasne s potekom desetih let od dneva dospelosti zavarovane terjatve.
V vsakem primeru pa je potrebno razlikovati tudi med prenehanjem hipoteke v materialnem in formalnem smislu. Tudi pri hipotekah, ki so materialno prenehale, je potrebno zagotoviti njihov formalni izbris iz zemljiške knjige. Vsaka, tudi zastarana hipoteka, namreč vse do izbrisa še vedno obstaja in tudi pravno veže.

Old mortgages: Limitation of mortgages in Slovenia
Is there an older mortgage registered on Your property? In certain cases, such a mortgage may already fall under statute of limitation. From the point of view of material law, the answer to this question depends on the law, according to which the very mortgage had been created/registered:
- Mortgages registered before September 1th, 1980, i.e. during the application of the General Civil Code (abr. in Slovene: ODZ). ODZ stipulated the statute of limitations on mortgages after expiration of the thirty-year term.
- Mortgages registered between September 1th, 1980 and December 31th, 2002, i.e. during the period of validity of the Basic Property Law Relations Act (abr. in Slovene: ZTRL). In accordance with the practice of the Supreme Court (see judgment opr. no. II Ips 844/2007 of 20/05/2010), mortgages registered during this period of time are considered not to have a statute of limitations. That is that the repayment right of the mortgagees from these mortgages does not expire.
- Mortgages registered after 1 January 2003, i.e. during the period of validity of the Law of Property Code (abr. in Slovene: SPZ). In the provisions of the third paragraph of Article 154 the current SPZ now stipulates that the mortgage expires ten years after the maturity date of the secured claim.
In any case, it is also necessary to distinguish between termination (of mortgages) in the material and formal sense. Even in the case of mortgages that had been materially terminated, it is necessary to ensure their formal deletion from the land register. Every mortgage, even an outdated one, still exists and is legally binding until it is deleted.
